General Terms and Conditions

1. Scope

These General Terms and Conditions apply to all appointment bookings, gift voucher orders and other services agreed through this website, the online booking system, email, telephone or in person between [Name of studio / business], [Insert address], hereinafter the 'Provider', and its clients.

Clients' differing terms apply only if expressly accepted by the Provider in writing.

2. Services

The Provider offers services in the field of [Insert service area, e.g. cosmetics, beauty, massage, coaching] . The specific services, content, duration and prices are set out on the website, in the online booking system or in an individual agreement.

The presentation of services on the website does not constitute a legally binding offer. A binding contract arises only upon confirmation of an appointment, confirmation of a gift voucher order or separate acceptance by the Provider.

3. Online appointment bookings

Appointments may be booked through the online booking system embedded in or linked from this website. Clients select a service and an available appointment and provide the information required for booking.

After completing an online booking, clients receive confirmation by email or another electronic channel. The appointment becomes binding only upon receipt of this confirmation.

The Provider reserves the right to reschedule or cancel appointments for good cause, particularly illness, technical problems, unforeseen operational reasons or force majeure. Where possible, an alternative appointment will be offered.

4. Clients' obligations to cooperate

Clients must provide complete and accurate information when booking. Any medical, physical or other personal circumstances relevant to a service must be disclosed before treatment without being prompted.

The Provider may refuse or discontinue treatment for objective reasons, particularly health risks, contraindications, false information or inappropriate behaviour.

5. Prices and payment

Prices stated at the time of booking or ordering apply. All prices are in euros and include statutory VAT where applicable.

Depending on the available options, payment may be made online, at the studio or by another agreed method.

Online payments use the payment service provider Stripe . Payments are processed by Stripe Payments Europe, Ltd., 1 Grand Canal Street Lower, Grand Canal Dock, Dublin, Ireland. When a Stripe payment method is selected, the payment data required for processing is transferred to Stripe.

The Provider generally does not receive complete credit card or bank account details. Stripe processes payment data under its own terms and privacy information.

6. Gift vouchers

Gift vouchers may be purchased through the website. They may be issued for a monetary value or, where offered, for specific services.

Following successful payment, the voucher is delivered electronically, usually by email to the address provided when ordering, or by another agreed method.

Vouchers are transferable unless expressly issued to a specific person. Their value cannot be redeemed for cash.

Vouchers can only be redeemed for the Provider's services. If the value is insufficient, the client must pay the difference. Any remaining balance may be used for further services while the voucher remains valid.

Vouchers are subject to statutory limitation rules. The standard limitation period is three years, beginning at the end of the year in which the voucher was issued.

The Provider accepts no liability for loss, misuse or incorrect disclosure of a voucher code unless responsible for the loss or misuse.

7. Cancellations, late arrivals and missed appointments

Agreed appointments are binding. Clients are asked to cancel or reschedule appointments they cannot attend as early as possible.

Cancellation or rescheduling is free of charge up to [e.g. 24 / 48 hours] before the agreed appointment.

For later cancellations or missed appointments, the Provider may charge a cancellation fee of [Insert amount or percentage] if the appointment could not be reassigned and the client does not demonstrate a lower loss.

Late arrival may shorten treatment time if the next appointment must start punctually. In this case, the full fee remains payable.

8. Right of withdrawal for online bookings and voucher purchases

Consumers generally have a statutory right of withdrawal for distance contracts. Details are set out in the separate withdrawal information on this website.

For services, the right of withdrawal may expire early once the Provider has fully performed the service, provided performance began only after the client expressly consented to it starting before the withdrawal period ended and acknowledged that the right would expire upon full performance.

For vouchers purchased online, the statutory right of withdrawal remains unaffected unless a statutory exception applies.

9. Voucher redemption and appointment availability

Buying a voucher does not create an entitlement to a particular appointment. Appointments are subject to availability.

To redeem a voucher, present it or provide its code when arranging the appointment, or at the latest before the service begins.

Applying a voucher retrospectively to services already paid for or completed requires the Provider's prior agreement.

10. Liability

The Provider is liable without limitation for intent and gross negligence, and for injury to life, body or health.

For minor negligence in breaching material contractual obligations, liability is limited to foreseeable loss typical of the contract. Material obligations are those necessary for proper performance and on whose fulfilment clients may ordinarily rely.

Further liability is excluded to the extent permitted by law.

11. Results and individual differences

Results of physical, cosmetic, creative or advisory services may vary individually. No particular results are guaranteed unless expressly agreed otherwise in writing.

The Provider's recommendations do not replace medical diagnosis or treatment unless the service is expressly medical and performed by an appropriately qualified person.

12. Copyright and content

Text, images, graphics, logos, designs and other website content are protected by copyright. Use, reproduction or sharing requires the Provider's prior consent unless permitted by law.

13. Data protection

Information about personal data processing, particularly for bookings, voucher orders, payments and enquiries, is set out in this website's privacy policy.

14. Dispute resolution

The European Commission provides an online dispute resolution platform. The Provider is neither obliged nor willing to participate in proceedings before a consumer arbitration board unless legally required.

15. Final provisions

The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers, this choice of law applies only insofar as it does not restrict mandatory consumer protection provisions in their country of habitual residence.

If any provision is or becomes wholly or partly invalid, the remaining provisions remain effective.
